The ten factors fiscal 2008, changes in legislation

Background Ten tax law changes for 2008

David Roberts

Our first article examines the top ten changes to our tax laws for 2008. This article will continue to review Change in reserve for us that American taxpayers in the great age of A.

One of them, a minimum reduction Replacement Tax Exemption. However, this particular change is strongly dependent on Congress to do what they did in the past two years and to make this change for December 31, 2007. AMT began in the 1960s, when some members of Congress have had the idea that this was not just for the rich "(60000/year $) to be able to deduct all costs and do not pay their fair share."

The problem occurs when the AMT was never indexed to inflation. Thus, while 60,000 dollars is considered rich in 1960 is not the case today. It is possible that many Americans who have never tried before losing some of their deductions. The key will be to ensure that if one approaches the mark of 69.950 U.S. dollars in revenue, to inspect the result of taking all their deductions and against the AMT, or perhaps just using the standard deduction.

Two, we have the deduction for depreciation of 50% special back! Taxpayers who place property in service in 2007 will be able to enjoy this benefit, the depreciation allowances in the first year. This property is in service must have a payback period of 20 years or less, qualified leasehold, property or utility of the water. This allowance is calculated according to Article 179 and before deduction of normal depreciation.

Three, if the assignment above applies in particular, the limit on depreciation and section 179 deduction for cars has increased by $ 8,000.

Four, section 179 expense deduction. The maximum increase of $ 250,000. The elimination of this benefit begins when property exceeds $ 800,000. Now, clearly, that is Article 179? The property placed in service has an expected life, cars, machinery, buildings, etc. Section 179 allows the owner of the company to maximize the full amount of depreciation the first year the property is commissioned. Thus, instead of taking one fifth of the depreciation in five years, five years of depreciation have been obtained in the first year. There some problems with this option. First, you have lost the deduction for the remaining years of the use of the property. Other hand, must sell the property before the period of useful life is over, you must pay taxes on the remaining amount of depreciation the first year. If the sale of the property should not, this option would make sense.

Five self-employment tax which affects many owners Small businesses will be more and more its "threshold of $ 1.600 to $ 4.200 with the ceiling may be increased to $ 6.300.

Six people the transportation industry, pilots, truck drivers, etc. of food expenditure ceiling has been increased by 80%. It is for meals consumed in use or time to do their work. For those who are not in the transportation industry, we are still dealing with the limitation of 50%.

Seven of the minimum tax credit for the previous year. For the fiscal year beginning in 2007, the refundable credit for the year being not less than one year refundable credit above, ie, before the phase of the IGA.

Eight foreign non-residents will no longer be able to claim exemption from tax on interest or dividend income related to dividend Short-term capital gains that were paid by a regulated investment company. (Time, why it should be a relief this tax simply because the individual has chosen not to become a citizen?)

We spendt about 10,000 in that period of two months and we have not made any sales. Any info would be greatly appreciated!
